Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Komos mobile application ("the App", "the Service"), an app for organizing events with friends (event creation, messaging, shopping lists, contributions, polls, and photo/video galleries). By creating an account or using the App, you fully accept these Terms. If you do not accept them, you must not use the App.

1. Publisher information

The Komos App is published by Mr Antoine Mura, a sole trader (French "entreprise individuelle") operating under the trade name "Komos", registered with the Caen Trade and Companies Register (RCS) under number 100 623 735 (SIRET: 100 623 735 00014), whose principal place of business is 73 rue de Bernières, 14000 Caen, France.

2. Acceptance and changes to the Terms

Acceptance of the Terms is confirmed via a checkbox when you create your account. We may update these Terms at any time, in particular to reflect changes to the Service or to applicable law. The "Last updated" date above reflects the latest version. We will notify you within the App of any material change. Continued use after notification constitutes acceptance of the updated Terms.

3. Access to the Service and account creation

• The App is free to use; connection and device costs remain your responsibility.
• Creating an account requires a valid phone number, verified via a code sent by SMS.
• You must be at least 13 years old (or the minimum age required by the laws of your country) to use the App.
• You agree to provide accurate information and keep it up to date.
• You are responsible for keeping your access credentials confidential and for any activity carried out from your account.

4. Description of the services

The App notably allows you to:

• create and manage events, and invite participants;
• chat through messaging tied to each event;
• manage shopping lists and contributions between participants;
• create polls (dates, availability, various choices);
• share photos and videos in an event gallery;
• receive push notifications related to your activity.

We reserve the right to evolve, suspend, or remove all or part of the features, without this giving rise to any compensation.

5. User obligations

When using the App, you agree not to:

• post unlawful, hateful, defamatory, violent, pornographic content or content infringing the rights of others;
• harass, threaten, or impersonate any third party;
• post a third party's personal data, or photos/videos of people, without their consent;
• distribute viruses, malicious content, or spam;
• attempt to gain unauthorized access to the Service, its servers, or other users' accounts;
• use the App for unauthorized commercial purposes or in violation of the law.

6. User-generated content

You retain ownership of the content you post (messages, photos, videos, etc.). You remain solely responsible for this content and warrant that you hold the rights necessary to publish it.

You grant Komos a non-exclusive, free license, limited to hosting, storing, reproducing, and displaying your content for the sole purpose of operating the Service (for example, showing your photos to the participants of an event). This license ends when you delete the relevant content or your account, subject to technical backup retention periods and legal retention obligations.

7. Komos intellectual property

The App, its brand, logos, interface, and software components are protected by intellectual property law. Nothing in these Terms transfers these rights. Any unauthorized reproduction or exploitation is prohibited.

8. Personal data

The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms. We do not sell your data and do not use it for advertising purposes.

9. Availability and liability

We strive to ensure the availability and security of the Service, without being able to guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance or in the event of a technical incident.

To the extent permitted by law, Komos cannot be held liable for indirect damages, loss of data, or the use made of content posted by users. Komos is not responsible for the actual holding of events organized through the App, which are the sole responsibility of their organizers and participants.

10. Suspension and termination

You may delete your account at any time from within the App. We may suspend or delete an account in the event of a breach of these Terms or of use that harms the Service or other users. Deleting your account results in the erasure of your personal data under the conditions set out in the Privacy Policy.

11. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and after attempting an amicable resolution, the French courts shall have jurisdiction, subject to mandatory consumer protection rules. In accordance with applicable regulations, you may use a consumer mediator free of charge for the amicable settlement of any dispute.
